These Terms of Use govern your access to and use of the Girard Property Limited ("Girard", "we", "us") website and application. By creating an account, you accept these terms. If you do not accept them, please do not use the platform.
1. Girard's role
Girard provides a technology platform for property management, lettings, cross-border property swaps, market intelligence and related concierge services. Except where Girard is expressly named as a party, Girard is not a party to any tenancy, sale, swap or other agreement reached between users. Girard does not guarantee any party, property, title, valuation or transaction, and nothing on the platform should be treated as legal, tax, valuation or investment advice.
2. Eligibility and your account
- You must be at least 18 years old and able to enter into a binding contract.
- You are responsible for the security of your login details and for activity on your account.
- You confirm that the information, documents and bank details you provide are accurate, current and lawfully yours to share.
- Girard may suspend or close an account where these terms are breached, or where fraud or unlawful use is suspected.
3. Fees
- Membership and subscription fees are payable as displayed at the point of purchase.
- An administrative fee of 5% applies to lettings on properties not uploaded by a Girard account. It is calculated with the rent and settled to Girard before closing.
- Rent settles to the bank account registered to the landlord or agent, unless the property is managed by Girard, in which case rent is collected into Girard's managed account.
- Payments are processed by Paystack, a licensed payment provider. Refunds and disputes are handled under our Dispute Resolution & Refund Policy.
4. Listings and verification
Users are responsible for the accuracy of their listings. Girard may carry out checks on property details, identity and documents as part of its internal process. Any check, badge or status shown on the platform reflects Girard's internal review only. It is not a guarantee, warranty or certification of title, ownership, condition, value or the conduct of any party, and it does not replace your own due diligence or professional advice.
5. Cross-border swaps
Swap participants are responsible for instructing their own lawyers and advisers to verify the transaction and to prepare, review and perfect all documents in each relevant jurisdiction. Where Girard facilitates escrow or a balancing payment, funds are released only when the agreed conditions and authorisations are met. Girard does not warrant title, marketability or the outcome of any swap.
6. AI-generated material
The platform uses artificial intelligence to draft documents and produce estimates and summaries. AI-generated content may contain errors and should be independently verified before use. Any document produced on the platform is a draft only and must be reviewed by a qualified lawyer before it is signed or relied upon.
7. Independent professionals
Agents, vendors and support-service providers on Girard are independent and act on their own account. They are not employed, verified or controlled by Girard Property Limited, and Girard is not responsible for their acts or omissions.
8. Acceptable use
- Do not post false, misleading or unlawful content, or content you do not have the right to share.
- Do not misuse other users' personal information, or use the platform to harass, defraud or discriminate.
- Do not attempt to interfere with, probe or circumvent the platform's security.
- Report suspicious listings, messages or conduct using the reporting tools provided.
9. Data protection
Personal data is processed in line with our Privacy Policy under the Nigeria Data Protection Act. You may request deletion of your account and data at any time via our account deletion page.
10. Intellectual property
The platform, its software, design and branding belong to Girard Property Limited. You retain rights in the content you upload, and grant Girard a licence to host, display and process it for the purpose of providing the service.
11. Liability
The platform is provided on an "as is" basis. To the fullest extent permitted by law, Girard is not liable for indirect or consequential loss, or for loss arising from a transaction between users, from reliance on AI-generated material, or from the acts of independent professionals. Nothing in these terms excludes liability that cannot lawfully be excluded.
12. Changes
We may update these terms from time to time. Material changes will be notified on the platform, and continued use after the effective date constitutes acceptance.
13. Governing law
These terms are governed by the laws of the Federal Republic of Nigeria, and the courts of Lagos State have jurisdiction, without affecting any mandatory rights you have where you live.
